1. Acceptance of Terms

By accessing our website or using our services, you agree to comply with these Terms. If you disagree with any part, you must discontinue using the site or services immediately.

2. Scope of Services

DOSbnb provides property management and virtual co-hosting services for short-term rental businesses. Our core services may include:

  • Revenue and occupancy management
  • Pricing optimization and OTA ranking improvement
  • Guest communication and 24/7 operational support
  • Cleaning coordination and vendor management
  • Maintenance coordination and issue tracking
  • Bookkeeping, owner statements, and reporting
  • Direct booking website setup and marketing

Specific services may vary based on individual client agreements or service packages.

3. Independent Contractor Relationship

DOSbnb operates as an independent contractor. Nothing in these Terms or any agreement with us shall be construed to create a partnership, joint venture, employment, or agency relationship between DOSbnb and any client.

We do not have authority to bind or represent any client unless expressly authorized in writing.

4. Payments and Billing

Clients agree to pay for services as defined in their respective agreements.

  • Payment Terms: 100% of the monthly fee is payable in advance before the start of the service period.
  • Accepted Methods: Card payment, bank transfer, or verified third-party platforms (e.g., Upwork).
  • Currency: Unless otherwise specified, all payments are made in U.S. Dollars (USD).
  • No Refunds: Once services have commenced, payments are non-refundable.
  • Taxes and Fees: Clients are responsible for any applicable transfer, conversion, or tax-related fees based on their region.

Failure to make timely payments may result in service suspension or termination.

5. Termination and Cancellation

Either party may terminate services by providing 30 days’ written notice. Immediate termination is allowed if:

  • Either party breaches agreed-upon policies or systems.
  • There is misuse of client platforms or confidential information, or
  • Illegal or unethical activity is detected.

Upon termination, clients are responsible for all payments due until the effective termination date. DOSbnb will return any client property, data, or materials upon request.

6. Confidentiality

DOSbnb agrees to maintain strict confidentiality regarding all client data, financial records, SOPs, and property-related information.

We will not disclose, copy, or use any confidential information except as necessary to perform contracted services.

Upon termination, all confidential materials and credentials provided by the client will be securely returned or destroyed.

This confidentiality obligation survives the termination of our relationship.

7. Data Protection and Integrations

We collect limited personal and business information necessary to deliver our services. This may include property details, revenue data, and communication records.

We integrate with third-party tools such as Hostaway, PriceLabs, QuickBooks, Turno, and others to perform our work efficiently.

While we take every precaution to protect your data, DOSbnb is not responsible for:

  • System failures, outages, or data loss caused by third-party platforms
  • Unauthorized access resulting from platform vulnerabilities, or
  • Actions of OTA platforms (Airbnb, VRBO, Booking.com, etc.).

We comply with applicable privacy laws, including GDPR and CCPA, to the extent relevant

8. Limitation of Liability

DOSbnb’s total liability under these Terms or any client engagement shall not exceed the total amount paid by the client for the preceding one-month service period.

We are not liable for:

  • Loss of bookings, revenue, or profit
  • Platform errors, suspensions, or data inaccuracies
  • Guest misconduct, damages, or cancellations
  • Any indirect, consequential, or incidental losses

However, we commit to working diligently, professionally, and in the best interest of each client’s business to achieve optimal results.

9. Performance and Service Disclaimer

While DOSbnb employs data-driven strategies and experienced professionals, we do not guarantee specific results, including but not limited to:

  • Increased occupancy or ADR
  • Platform ranking improvements
  • AirCover or damage claim approvals

Our commitment is to apply industry-standard methods and continuous optimization to achieve the best possible outcome for our clients.

10. Intellectual Property

All materials, tools, and processes developed by DOSbnb remain the exclusive property of Digitech Outsourcing Solution LLC unless otherwise agreed in writing.

Clients retain ownership of their property data, images, and listings but grant DOSbnb permission to manage and modify content as needed during the service period.

11. Non-Solicitation

Clients agree not to directly hire, contract, or solicit any DOSbnb employees, agents, or subcontractors for a period of one (1) year following the termination of services.

This helps protect the integrity of our operations and prevent conflict of interest.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

We aim to resolve all concerns amicably through discussion and mutual understanding. If a dispute arises:

  1. Negotiation: Both parties will first attempt to resolve it through direct communication within 30 days.
  2. Mediation: If unresolved, the parties agree to participate in mediation under Delaware law.
  3. Litigation: If mediation fails, either party may pursue legal action in Delaware courts.

Each party agrees to continue performing its obligations in good faith during dispute resolution.

14. Amendments and Updates

DOSbnb reserves the right to modify or update these Terms at any time.

Any significant changes will be announced via our website or by email to existing clients at least 30 days before the new Terms take effect.
